Even after judicial approval, extradition is not automatic. The Ministry of Justice conducts an independent executive review before authorising surrender. This administrative phase permits consideration of humanitarian factors, diplomatic implications, and assurances from the requesting state regarding treatment and prison conditions. Defence counsel can submit representations directly to the Ministry raising concerns not fully addressed in court proceedings. The Ministry may impose conditions on surrender, delay execution pending assurances, or in rare cases decline to execute the court order. This executive discretion creates a final opportunity to prevent surrender on human rights grounds.
