The forum bar under Section 83A of the Extradition Act 2003 allows a judge to refuse extradition if a substantial part of the alleged conduct occurred in the UK and it would not be in the interests of justice to extradite. Courts consider where most of the harm occurred, the interests of victims, the availability of evidence, and prosecutorial decisions. In practice, the bar is rarely successful — courts have interpreted it narrowly, and you must demonstrate that UK prosecution would be materially preferable. It requires detailed evidence about the location and impact of the alleged offending.
