Factors include the seriousness of the alleged offence, the requesting country’s human rights record, and whether the notice appears politically motivated. The NCA may refuse to circulate notices from states with documented patterns of abuse, such as Russia or certain CIS countries. If the NCA has circulated a notice against you, it is possible to challenge this decision through judicial review in the Administrative Court, arguing that circulation is unlawful or disproportionate based on the specific circumstances of your case.
