Thai courts and the Attorney General’s Office are required under the Extradition Act B.E. 2551 to refuse extradition if the person would face persecution, torture, or flagrantly unfair trials. However, Thailand’s application of these protections is inconsistent, particularly regarding requests from countries with which it maintains strong diplomatic relations. Presenting documented evidence of human rights conditions—UNHCR reports, UN Special Rapporteur findings, credible NGO assessments—is essential during both extradition hearings and CCF proceedings. The burden falls heavily on the individual to prove specific, personal risk rather than general country conditions.
