Morocco generally does not extradite Moroccan citizens to foreign states, consistent with Article 721 of the Code of Criminal Procedure. However, this protection applies strictly to nationals — dual citizens may face complications depending on how Moroccan authorities classify their primary nationality. When extradition is refused, Morocco may instead prosecute the individual domestically under the principle of aut dedere aut judicare. Foreign states can transfer case files to Moroccan prosecutors, meaning avoiding extradition does not guarantee avoiding prosecution for alleged offences.
